As an overview, our commitment to privacy is based on the following principles:

What information do the Sites collect from you?
Personal Information:Picha collects and stores personal information that you provide at the time you register for a Picha account, including your username, password, name, address, email address, phone number, and any other information requested from you at time of registration. Picha also collects and stores additional personal information you provide to process financial transactions or to facilitate Picha’s ability to provide you with products and services, such as credit card, banking, and/or electronic payment information and billing addresses. Although it is not mandatory to provide Picha with such information, certain products and services may not be available to you if you choose not to provide Picha with such personal information.
IP Addresses, Cookies, and Log Files:When you visit the Sites, Picha may collect certain information automatically as part of the Sites’ operation, such as yourinternet protocol (“IP”) addresses for systems administration and troubleshooting purposes. (Your IP address indicates the location of your computer on the internet. It is not necessarily a unique personal identifier.) The Sites do not generally link IP addresses to anything personally identifiable.
The Sites also use advertising servers and/or processes developed by third parties to display ads. Some of these ads may contain cookies that are set by third parties (e.g., advertising agencies or advertising clients). While the Sites may have access to many of these cookies, and any information that they contain, the Sites do not share any such cookies or information from such cookies with third parties other than those who control the cookies, i.e., the advertiser and its agents. We have no control over how the advertiser or its agents may use the cookie information that the advertiser has collected.
Navigational Information:Picha collects and stores certain information about how you access and navigate the Sites, such as the pages you view, the links you click, the times at which you access and that you spend on the Sites, your geolocation, the device you used to access the Sites, and other details related to any transactions you make on the Sites. Picha may combine your personal information and/or IP address with navigational information. Picha does not otherwise track or collect your personal information across third-party sites when you exit the Sites.
How can you “opt out” of providing,or update, your personally identifying information?
You may “opt out” altogether from providing personally identifying information to us by not registering as a user of the Sites at the registration page and thereby not providing personal information. You may also choose at a later date to have your name removed from our database by deleting your registration profile. Certain portions of the Sites and certain services provided on the Sites, however, do require registration in order to access or use these areas and services. If you choose not to register or provide the requested information in connection with registering for a Picha account, areas requiring registration will not be accessible to you.
You can correct, update, or delete inaccuracies in information about you by making changes on your Picha account profile. We may not be able to delete your personal information except by also deleting your user account, and we may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
What do the Sites do with the information they gather and/or track?
Facilitate Transactions:Picha uses your information to facilitate transactions and to provide our users with our products and services. This includes using your information to process orders and invoices, to allow you to upload or download images, to maintain and update your Picha account, and to contact you in response to inquiries or messages from you.
Legal Compliance:Picha may also use, share, or disclose your information, as necessary, to comply with any court order, law or legal process, including to respond to any government or regulatory request; to enforce or apply our Terms and Conditions, content license agreements, contributor agreements, or other agreements existing between us, including for billing and collection purposes; and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Picha, our customers, or others, including exchanging information with other companies and organizations for the purposes of monitoring copyright infringement, fraud protection, and credit risk reduction.
Statistical Analyses and Advertising:Picha and its agents may perform statistical analyses of user behavior on the Sites to analyze trends, measure interest in the various areas of the Sites (for product development purposes, as well as for internal management purposes), and to inform advertisers how many users have seen or clicked their advertising content. Pichamay also use users’ information to allow products, services, and/or advertising on the Sites to be targeted, in aggregate, to users for whom the products, services, and/or advertising may be most pertinent. This means that usersmay see the products, services, and/or advertising that Pichaor its advertisers believe are most likely to interest users, and Picha or its advertisers may send their messages to the people who are most likely to be receptive, improving both the viewer’s experience and the effectiveness of the products, services, and/or ads. In these statistical analyses and advertisement targeting, Picha will disclose information to third parties only in aggregate form.
International Transfer: To facilitate transactions and provide its services and products to users, Picha and its agents may collect, store, and process users’ information, including personal information, using servers in the United States, South Africa, and other jurisdictions, as necessary. By using the Sites and/or providing any personal information, you consent to the transfer of information about you to and from servers both within and outside the United States and South Africa. Wherever possible, Picha will attempt to provide a commercially reasonable level of data protection in any jurisdiction in which it collects, stores, transfers, or processes information.
With whom do the Sites share the information they gather and/or track?
Picha shares the information it gathers, in aggregate form, with advertisers and other partners. Picha generally does not release personal information about you as an individual to third parties. Picha may share information about you, including personally identifying information, if sought by legal process or requested by law enforcement, or in order to protect the rights and property of Picha or the safety of our users or the public, or to protect against unauthorized use of our site. Picha may also share information about you with third parties as part of any corporate reorganization process, including, but not limited to mergers, acquisitions, and/or sales of all or substantially all of our assets.
How long do the Sites retain user information?
Picha retains your information as long as you maintain an account with Picha or as needed to provide you with our services and products. If you wish to cancel your Pichaaccount or request that we no longer use your information to provide you services, contact us at firstname.lastname@example.org. If you choose to terminate your account with Picha, we will retain and use information about you only as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
How do the Sites protect their content and user information?
Pichaand its agents take commercially reasonable precautions to protect our users’ information. To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information, we have put in place commercially reasonable physical, electronic, and managerial procedures to protect the information we collect online, including encryption security for credit card and/or electronic payment submissions. Such commercially reasonable precautions, however, do not absolutely guarantee the complete protection of your personally identifying information. By using the Sites, you acknowledge that there will always be some risk that any personally identifying information that you provide to us may be released without our permission or knowledge, and we are not responsible for circumvention of any privacy settings or security measures we employ.
Furthermore, the safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Sites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
Are the services of the Sites available to minors?
Anyone under the age of 18 is not eligible to use the Sites’ services or products, and such individuals should not submit any personal information to us.
Forums and Other Interactive Services
The Sites may include discussion forums or other interactive areas or services, including blogs or other areas or services in which you or third parties create, post, or store any content, messages, comments, materials, or other items on the sites (“Interactive Areas”). If you use an Interactive Area, you should be aware that these areas are open to the public, and any personal information you post may be viewable by others. We are not responsible for personal information you post or submit in connection with the Interactive Areas, nor are we responsible for how others might use that information, including to send you unsolicited messages. Interactive Area postings may be retained indefinitely. If at any time you would like to remove a posting, please email us at email@example.com. Keep in mind that removal of a posting from an Interactive Area does not mean that the posting will be deleted from our systems or from the Internet.
